MAGISTRATE'S COURT. Pukekohe— Thursday. (Before Mr F. V. Fraser, S.M.) UNDEFENDED CASES. Judgment was given for-plaintiffs by default or consent in the following cases :—Green and Colebrook v. James, £34 5s 6d, costs £2 15s ; F. Perkins and Co. v. E. Gosling, £57 13s, costs £3 2s. SCAFFOLDING. The inspector of gcaffoldicg proceeded against J. Penman for setting up scaffolding over 16 feet high without notifying the inspector. Defendant, who was represented by Mr Hopkins, pleaded not guilty. - For the defence it was contended that the builders, had applied and been granted permission to erect scaffolding, when the reconstruction of the building (which was formerly known as Noonan's boarding house) was commenced. As doubt existed as to what form the application took the case was adjourned until the next sitting of the court to permit of the production of the letter. UNHAPPY MABRIAGE. Isabella Louisa Tilly (Mr Fitzherbert) applied for a separation order Irom her husband "W. B. C Tilly (Mr Haddow), and asked for maintenance and the custody of the child. Evidence given by the plaintiff, who had left her husband and was living in -Auckland, and her daughter showed that defendant wfts violent in manner, used threats against his step-children (plaintiff having been married twice) and plaintiff. It was said the defendant had on one occasion brcken all the crockery in the.house. The application for a separation order was withdrawn. The defendant deposed that the unpleasantness had arisen through the step-children, who were encouraged by the plaintiff not to assist in the work of the farm. He detailed his financial position and said he was unable to pay £1 a week maintenance. "It has been an unfortunate marriage. They should never have been married. It is lidiculous to ask. the wife to go back, because they would never agree," remarked Mr fraser. He made an order to maintain the dhild at the rate of 7s 6d per week and the plaintiff to have custody of the child, defendant to pay costs, one guinea. A WAGES DISPUfE. A dispute as to amount of wages agreed upon was the reason for J. Appleby (Mr Haddow) suing Mr M. Bdutly (Mr Fitzheibert) for £5. Plaintiff claimed that defendant had arranged, on account of breaking his leg, to give him 30s a week, irom September 16th, 1912, to March 9th, 1913, and had only paid him at the rate of 255. Evidence for the defence was given by defendant and his sister to the effect that the agreement was for 25s a week ; the plaintiff had since worked for defendant and only a month ago had said anything about the extra money.
