TO THE BDITOE. Sir, —In a recent issue of the Mercantile and Bankruptcy Gazett 6 is a paragraph which I have ventuied to copy, as it may prove of interest to at least a few members of the community :

“ A case was heard at Loughborough County Court, in which a retired lawyer named Giles claimed five guineas from a farmer named Walker for damages to his garden through thistles. It was stated that Walker’s field, 300 yards away, grew thousands of thistles, the down from which was carried by the wind into Giles’ shrubbery and garden, being caught by the trees. Giles said he had 'employed three men and a woman pulling up the thistles. After four hours hearing the jury gave a verdict for the plaintiff, assessing the damages at three guineas. The defence was that the thistles grew on the surrounding land also.” >

Now, Sir, any one passing along the Kaituna road within the town boundary, cannot fail to notice the luxuriant growth of.gorse, which, in one place, has taken complete possession of one of the cross roads, and appears to he spreading rapidly. I should be glad to know whether, it action is taken, by residents in the vicinity who may suffer through the pest, such action would lie against the Havelock Town Board, who appear to altogether ignore the evil, or against the person from whose land the pest spread in the first place.—l am, &c., Homo.
