R.M. COURT, GISBORNE.

(Before J. Booth, Esq., R.M.) THIS DAY. Bougen v. Morse. Plaintiff charged H. Morse, who is a licensed victualler, with assaulting him on the 25th September, and repeating the offence on the following day. Morse v. Bougen. This was a cross action charging Bougen with using insulting language in Morse’s public house on the 26th, the day mentioned above, saying “ You are a b y rogue, and make your living by roguery. Come outside and I will take it out of you,” and on the following day using the words, “ You know what I told you last night. You are a b y rogue. If you were any man at all you would come and put me out.” The above and two cross-actions between the parties were adjourned till Saturday next.

Rutene Te Aowhakapipi and Hone Rangitakina were charged by the police with a breach of the peace on the 27th, viz., fighting in a public street. Both pleaded guilty, and said they were drunk at the time.

Constable Marsh said owing to the officer on duty at the time being at the Court with a prisoner, hd had not seen the fight, but it continued for some time.

Mr. Turton, solicitor, gave evidence as to having seen the fight, and gave a succinct account of the circumstances attending the case. He believed if it had not been for the disgraceful conduct of certain Europeans urging them on, the fight would not have been of any extent. Fined £2 each, and costs 4s. 6d. each ; in default seven days imprisonment.
