Some doubt was expressed yesterday as to the legality of holding the meeting of creditors in the estate of W. D. Lysnar, as the proper notice had not been given. It was argued that the advertisement should appear in two papers, whereas it had only been published in one. Dlr. E. K. Brown inquired of the Registrar, who decided that two papers did not necessarily mean two papers with different titles, but two issues of the same paper were sufficient. We dissent altogether from such a view, although the language of the Act would form an excellent subject for debate. This particular case is under the old Act, which, at page 454, subsection of section four says: — “Gazette shall mean any newspaper published and generally circulated within the district in which the proceeding or matter is taken or pending; and ‘ gazetted ’ shall mean published in !wo or more such papers for the district in which the proceeding or matter taken is pending.” Now, one insertion in a paper includes publication several hundred times, so that we think the intention can only be that the matter shall appear in two papers of different titles. This has been the rule for many years, although perhaps it is a debateable point, and one which steps should be taken to
decide at once. There is a vast difference between the meaning of the words two or more papers, and twice in any one paper, or at /zw different periods in the same paper. Which is correct ?
