(Before J* Booth, Esq., R.M.) SATURDAY. BREACH OF HARBOR BY-LAWS. H. E. Johnstone was brought up charged with a breach of Harbor Board By-law No. 2. Mr, Nolan appeared for the prosecution) and Mr. Brassey for the defendant; After considerable discussion as to legal points, and several objections having been raised and overruled by the Court, several witnesses were called, including Messrs. P. Milne, J. Bourke, and the defendant. After hearing the evidence, his Worship said there was no room for doubting that a breach of the by-law had been committed, but, taking into consideration several mitigating circumstances, he would only inflict the nominal fine of £1 and costs, £2 10s. Mr, Brassey gave notice of appeal.
