RESIDENT MAGISTRATE’S COURT.—GISBORNE.
(Before J. Booth Esq., R.M.) TUESDAY. Bank of N. Z. v Greene. Mr Kenny appeared for the plaintiff. This was an action to recover the sum of £4O 8s 2d, the amount of an overdraft. Judgment for the amount and costs, £2 19s. Cooper v Riria Pahewhal Mr Kenny applied for costs iu this case as judgment Lad been confessed without giving formal notice. Costs granted. Egens v Boland. This was an action to recover the sum of £3 4s, for wages due, as alleged by the plaintiff, for work done in his capacity as engineer. Mr Egens, the plaintiff, deposed—That the defendant had engaged him, on Tuesday the 4th of September, as driver and engineer of the locomotive engine in connection with the gravel contract. He had worked 86 hours and his wages was la fid per hour Hud received £3 10s, and claimed a balance of £3 4s, which was still due and owing to him. After a lengthened cross-examination on the part of Mr Boland, which tended to show that the plaintiff had not worked the time set forth in the claim ; and had al-o agreed to work for the same wages as Ihe other engineer ; likewise that the plaintiff had neglected his work. Judgment for the defendant.
