RESIDENT MAGISTRATE’S COURT.—GISBORNE.
[Before J. Booth, Esq., R.M.] Tuesday. Davis v. Turton. Claim £2 9s 7d. The defendant did not appear. Judgment by default for amount claimed, and costs 7s. Davis v. Goldsmith. Judgment confessed. Mr. Brassey applied for allowance of fees, £2 2s, as the debt was only confessed five minutes before the Court sat. He argued that he was entitled to his fees in the case.—Granted. C. Anderson v. Sam pie. Mr. Brassey appeared for the plaintiff. Claim £3 16s 9sd, for goods supplied. The defendant did not appear. Judgment for the amount claimed, and costs IBs. C. Anderson v. T. Wright. Confessed. S. M. Wilson v. H. Potahi, Enlarged. Common v. A. Y. Ross. This was a judgment summons for £6 6s. Mr. Shelton appeared for Mr. Common by virtue of powers of Attorney. The defendant having been examined as to means, an order was made to pay the full amount on or before this day six months, in default two weeks imprisonment. F. Percy v. Bidgood. Mr. Sherar appeared for plaintiff, Mr. Kenny for defendant. This was a claim for £2O 12s 6d, wages due for 16| weeks, at 25s per week, The plaintiff stated that he was in the defendants service from April 10th to August 4th, during which time he had received only small sums of money, such as Is and once or twice ss. He had received goods in the shape of tobacco and blankets, amounting in all to about £7. He could never get any settlement from Mr. Bidgood. He left him without notice because he could get no money. Mr. Bidgood stated that he was a carrier at O»-mond. When he engaged the plaintiff there was nothing said about the amount of wages to be given. First-class men got 25s per week, second class men 21s, and inferior men what they could get, A first class man could do anything that was wanted. Plaintiff was only a second class man, and drove against poets and into ditches. He had paid the plaintiff £l6 7s 6d in all. He had entered all the items up in the book himself. There had been a great scarcity of labour this winter in the Bay. Usually men were glad to get what they could in the winter. Judgment for the full amount claimed, less £l6 9s 6d. Costs allowed, £4 Bs. A. AILANACH V. BHEEMAN. Claim £l, balance of account. Mr. Robin* son for plaintiff, and Mr. McDougall for defendant. Judgment for the amount with costs, 7s. Wednesday. Assault. Owen Lynch was brought up and charged with assaulting Thomas McG)*a on the 17th of August, at the Willows, by striking him violently in the face with his fist. The defendant pleaded guilty, and was fined lOs, with costs, £?, in default of payment by one month, seven days imprisonment. J. C. Davis v. 0. Goldsmith. This case was brought by the plaintiff, praying that the defendant be bound over to keep the peace, as accused had used strong and violent language to him, and he was in bodily fear of his life. Mr. Turton, on behalf of the accused, said that he would plead guilty, but that the defendant was intoxicated and did not know what he was doing, that he did not remember using violent language to Mr. Davis. After hearing the complainant His Worship fined the accused £3, with costs, Ils. In default of payment, six months imprisonment with hard labour, and was bound over to keep the peace for the next six months, in two sureties of £2O, and himself in one surety of £4O.
