GISBORNE HARBOR BOARD.
We here reprint the Gisborne Harbor Board Bill, introduced by Mr McDonald, M.H.R., which has passed both Houses and has now become law :— A Bill entituled an Act to constitute a Harbor Board for the Port of Gisborne. Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows :— 1. The Short Title of this Act is “The Gisborne Harbor Board Act, 1882,” and it shall come into operation on the first day of October, one thousand eight hundred and eighty-two. 2. Subject to the provisions hereinafter contained this Act shall be deemed to be a special Act within the meaning of “The Harbors Act, 1878,” which Act, and all Acts amending the same, shall be incorporated with this Act. 3. In this Act, if not inconsistent with the context, — “ Board” means the Harbor Board constituted under this Act: “ Port” means the Port of Gisborne as defined by this Act, or as may be defined under “The Harbors Act, 1878,” or any Act amending the same: “The said Act” means “The Harbors Act, 1878,” and all Acts amending the same. 4. The Port of Poverty Bay, as defined by a Proclamation of the Governor, dated the twenty-sixth day of May, one thousand eight hundred and seventy-four, is hereby designated the Port of Gisborne, and shall henceforth be known by such name, and the limits of the said port shall be those of the Port of Poverty Bay, as set forth in the aforesaid Proclamation, or as may hereafter be defined as hereinbefore provided. 5. The Borough Council of the Borough of Gisborne is hereby constituted under the said Act a Board for the Port of Gisborne ; and, in the exercise of its functions, and the conduct of business as a Harbor Board, shall in every respect be subject to the provisions of the said Act, and shall conform with all the requirements thereof. The Governor shall appoint the day and place of the first meeting of the Board. 6. The Governor in Council, in the name and on behalf of Her Majesty, may issue a grant to the Board of the lands described in the Schedule hereto, in trust for harbor purposes ; and the Board, after the issue of such grant, shall have authority to reclaim the same from the sea. All rents, issues, and profits arising or derived from the said lands shall be paid into and form part of “ The Harbor Fund Account." 7. The Board is hereby empowered to purchase any existing harbor works within the port, and to execute under its common seal all deeds or instruments which may be necessary for the purpose of affecting any such purchase.
SCHEDULE. Dxscriftiox of Fokeshohk. All that parcel of land situate In the Poverty Bay District, Provincial District of Auckland. Bound towards the North by high-water mark of the ocean, from a point in line with the production of the western aide of Lytton Road, in the Town of Gisborne, to the foot-bridge across the Waikanae at Lowe Street; towards the Weat by that bridge to high-water mark on the left bank of the Waikanae; towards the North and Weat by aaid high-water mark to the northern end of Lytton Road aforesaid, on the right bank of the Taruheru; towards the West by a line in continuation of the western side of the said Lytton Road to high water mark on the left bank of the Taruheru River; again towards the North by highwater, to a point opposite the confluence of the Taruheru with the Waimata; thence by a line running due East to the left bank of the Waimata River at high-water mark; towards the East by said high-water mark to a point about GOO feet up the Haupuawhakapatu Creek; thence by a line running South to high-water mark on the left bank of the said creek ; thence by said high-water mark to and along the Turanganui River and the ocean to a point about 3500 feet in a direct line from Maori Point,- thence by a line due South to low-water mark, and thence generally towards the South by low-water mark to a point opposite the western side of Lytton Road ; thence towards the West by a right line running due North to the starting point.
