RESIDENT MAGISTRATE’S COURT, GISBORNE.
Monday, Februvry 20, 1882. [Before V. Price, Esq. R.M.] Robert Turnbull was charged on rc naml with the larceny of a shoe’, r a’vl. and o’her effects tin* pronerty of Wirenni lleroroa, a! Makaraka, in Noveniber S<Tg(‘?nt Bullen prosecuted. Mr Brassf’y appeared for the ac cused’ who pleaded not gtiihy. I he evidence of t’le pro*er'Hor wa< to the eff«’C’ that he lost the things at Makaraka. late one evening in November while on his way through to Opotiki. Constable Walsh deposed as to findtbe articles in accused’s house. Accused’s statement to the constable was that he found I ho ar’ides tied up in a bag lying on the road near Mr King’s, on his way home from Mr Oxenhatn’s one dark, wet night in November last. Mr Bra-sey addressed the Court for the defence and called Mr Oxenham (in whose employ tin* accused has been for the last three years), who gave him an excellent character. His Wor-hip in pronouncing his de-ci-ion dealt with the fact that no evidence of a s:ui<factory nature was forthcoming to show that die accused had taken any means 1<» find out the owner of the goods, and taking the circ imsianc(‘s of the case into consideration passed a sentence of thirty days’ imprisonment in the Gisborne IjaoL
