Case adjourned to Tuesday, the 3rd January next, on the understanding thatthe costs already incurred amounting to £lO 7s, are paid by the defendant on Friday inext, the 23rd December. M'DOWELt V. BOROUGH COUNCIL. Adjourned to Tuesday, 3rd January next. M. MULLOOLY V. RANIERA TUROA. Adjourned to the 24th January next. H. E. WEBB V. W. L. REES. Mr Brassey for plaintiff ; Mr Robinson for defendant. In this case, which has been adjourned several times, defendant applied to have his evidence taken in Auckland, on the Bth inst., which he failed to do, but applied for a further adjournment, owing to his absence in Napier. Mr Brassey contended that there were no good grounds for delay, but under the circumstances would consent to an adjournment to Tuesday, the 3rd of January, on the understanding that the case be heard that day, whether the defendant be present or not. Tne Court made a record to that effect, and allowed plaintiff’s costs. w. SEARLE V. R. COOPER. Claim, £5. Judgment confessed by Mr Brassev. counjcl for defendant.
