Mr Brassey for the plaintiff; Mr Robinson (for Mr Rees) for the defendant. In this case, which has been adjourned several times, defendant applied to have his evidence taken in Auckland, on the Bth inst., which he failed to do, but applied for a further adjournment, owing to his absence in Napier. Mr Brassey contended that there were no good grounds for delay, but under the circumstances would consent to an adjournment to Tuesday, the 3rd of January, on the understanding that the case be heard that day, whether the defendant be present or not.
