RESIDENT MAGISTRATE’S COURT, GISBORNE.
Friday, August sth, 1881. [Before M. Price, Esq., R.M.j-*'' Wm. Dixie was charged on the information of Mrs. S. DeCosta With an attempt at assault, and craved that he be bound over to keep the peace. The Gaoler gave testimony .to the that the prisoner had been under his charge for the last 28 days, and thought that lie had shown symptoms of aberration. He was of a brooding, melancholy, turn of mind, and did not, at times, seem to remember things. The prosecutrix, sworn, Reposed that the accused came to the Turanganui Hotel, on Thursday last, about noon, and said he wanted to speak to her. She declined, and he got very excited, and made a rush at her across the room, and had not assistance been at hand she did not know what the consequences would have been. Constable Walsh passed at the time and took the accused into custody. Constable Walsh deposed to talking to the accused some time before he was released from custody, and advised him not to go to Mrs. DeCbsta’s when he came out. He- said he would go and “do for her.” Walsh told him he was very foolish and ought to clear out. ' In reply to questions from the Bench, the accused said he had no evil intention against Mrs. DeCosta, and only went to her house to speak to her. The Magistrate said it could not be tolerated that the prisoner' should annoy unprotected women in the way he had done, and bound him over to keep the peace for 12 months, himself in £5O, and two sureties of £25 each ; failing which to be imprisoned in Napier gaol for 6 months. . lye believe the required bail was not forthcoming, and accused was sent to Napier by the Rotomahana yesterday. CaNTLE V. CUFE. Judgment summons for £2B 9s. Order made that the amount be paid by instalments of £4 per month. Krippner v. Matthews. Judgment in this case will be delivered on Tuesday next.
