RESIDENT MAGISTRATE’S COURT, GISBORNE. Friday, June 3rd, 1881. [Before M. Price, Esq., R.M.] GRAHAM & CO. V. OTENE PITAU. Claim, £lO 9s 2d, goods supplied. Judgment for plaintiff. H. I. WALKER V. A. SKILLICORN. Mr Brassy for plaintiff. Claim, £47 5s |d, balance of account for skins and wool. Defendant pleaded not indebted, and non-de-livery. A. J. Cooper deposed to having deported the said skins and wool from the Waikohu station, according to defendant’s instructions ; he put them on the bye-road for the night, and forwarded them next day to his woolshed. His Worship explained to the defendant that the law was on the side of the plaintiff. Mr Skillicorn’s own carrier swore to taking delivery of the goods, and if they were not delivered to him (the defendant) that was a matter outside Mr Walker’s claim. Judgment for plaintiff with costs, £4 19s 6d.
