RESIDENT MAGISTRATE’S COURT, GISBORNE.
Friday, May 20th, 1881. [Before M. Price, Esq., R.M.] E. PAVIOUR V. J. VILLERS. Claim £46 5s 6d, alleged to be due for wages, while in the service of the defendant, at the Chandos Hotel. The defence upon the loss of the defendant’s Day book, Mr. Villers stating that the book had been stolen from his Estate, after he left the hotel, and the books were in the possession of '<lie plaintiff. The plaintiff on evidence deposed a to the loss of the Day book, but could give no satisfactory account of the loss. He was responsible for their jeustodv. An adjournment was made to 12 o’clock to enable the defendant to inspect the books of the Estate ; but, on the re-asembling of the Court, nothing further was adduced, and judgment was recorded for the plaintiff, for amount claimed, and costs.
