Read v. Hemi Waka.— Claim £5O, being amount of order given by defendant on Messrs. Westrup and Johnson, which was dishonored. Judgment for plaintiff with costs.
An Arbitration Case came before the Court on Monday last, but possesses few points of interest beyond the persons concerned. It appears that Mr. Weston has had some differences with Messrs. Johnson and Westrup, from whom he leased a dairy and a right to milk a certain number of cows. The agreement, under which Mr. Weston held, was shown to bo incomplete and unsatisfactory, which gave to both lessors and lessee many opportunities to interpret its provisions according to their own idea or inclination, tho doing of which caused many complaints and counter complaints to be made resulting in tho present arbitration. The arbitrators (W. K. Nesbitt, Esq., R.M. ; and J. B. Poynter, Esq , J.P. ;) decided that although tho lessors hail many just causes of complaint, they (the arbitrators) considered that the lease being so loosely drawn, they could not recommend its forfeiture, but that another lease bo prepared setting forth more clearly the conditions to which both parties consent.
