Robert Williams deposed to having met the defendant coming from Gisborne; that he showed him some papers, and told him if he did not dear

up the matter he would summon him. Defendant hit him with his whip handle and drove on.—By defendant; My trap wm not standing across the road when you came up. You did not call out to me to dear off the rood. 1 was not drunk. I had had a few nobblem. I did not fall off the trap. I had words with you about a week before and called you anything but a gentleman. The defendant denied the charge mid stated the complainant was drunk. Case dismissed without costa.
