PATEA—THIS DAY. (Before C. A. Wray, Esq., R.M. CIVIL CASES. Brown v. Dixon.— Claim LI 12. Judgement for plaintiff by default, with costs 7s. Administratrix in the estate of D. Sullivan v. Sparks. —Claim LI 3s sd. Mr Hamerton for plaintiff. Defendant asked for an ahjomnment on the ground that he believed that he had a receipt at home. The plaintiff was called and stated that defendant had never paid the claim. The case was adjourned in order that the defendant might produce the receipt. Same vßaxter. Claim L 7 12s sd.—Mr Hamerton said that this was a case that had been brought on before when Baxter a block of a cheque for LlO, money which he said he bad lent to Sullivan, the plaintiff. As he had not pleaded this amount as a set-off it was now too late to do so.
The plaintiff gave evidence to the cflect that the defendant had obtained goods to the value claimed for which he had not paid. The defendant examined by Mr Hamerton said be had resided in Patea for 8 years. On two occasions he gave Mr Sullivan a cheque. Before the date of the present account he had given a cheque to Sullivan. He thought he still owed a pound or so. Judgment for plaintiff for amount claimed with costs. Same v, Wright.— Claim Li 12s sd. Mr Hamerton. for plaintiff. Judgment for plaintiff for amount claimed, to be paid in weekly instalments. The Court then adjourned.
