This Day, before Mr Wray, R.M.
DEBT CASES. Ladd v. Neary (Skelly’s estate), adjourned for a week. Wilson v. Stiles, no appearance.
Wood v. McKay was a claim for rent of house and hire of a horse.
Mr Barton, for plaintiff, said amended particulars had been sent in since last
hearing. Alfred Wood, plaintiff, said defendant became tenent of a house near Bedfordatreet on March 15th, last year. In addition to arrear of rent, he hired a horse at 3s 4d a day, amounting to£43s4d. Mr Hamertqn, for the defence, contended that two statements of account had been rendered, and the items did not agree. dfeorge M’Kay,. defendant, a butcher, gave evidence df payments made at irregular intervals, and said he had paid sums for which credit was not shown in the account. As to horse hire, he had only used it once, after telling plaintiff he could not afford to pay 8s 4d a day. Did not return the horse because he lost it more than a week. Could not say when he returned it, but did so as soon as he found it.
Defendant’s wife swore to paying portions of the rent.
Mr Barton thought this witness’s statements were probably right, and the amounts said to be paid might be deducted.
Magistrate reduced the claim for horse hire to £3, as that amount had been claimed in one account. Judgment for £9 2b 6d. including costs.
