BYE-LAWS OE THE BOROUGH OF PATEA.
The following Bye-laws. abd Amendment are published for public information in accordance with the provisions of. the “ Municipal Corporations- Act, .1876.” Part Vl,—Nuisances.' ADDITIONAL BYE-LAW. : 117. No person shall keep any swine within, snch part of the borough as lies within block Np. 46, on the plan of the borough. And this bye-law is to be taken and read as ami be subject to the same pains and penalties for any breach thereof as No. 103 of these bye-laws, r i Part Vll,—Buildings for Public Meetings, Ac--118. The following fees shall be paid for every license to use any room within the borough for . any of the purposes hereinafter mentioned, for -one year or any less period. For every room used for public performance or amusement, £3. • ■ 119. Any such building niay.be used for the purpose for which it is registered at all hours during the day or night. j , Part Vlll—Carriages. 120. No vehicle shall ply for hire for the carriage of passengers or goods within the. borough,- except iii pursuance-of a -license granted' by- the jcouncil Tinder these bye-laws,.and--no licensed vehicle; shall ply, Tor hire for any other purpose than-that for which it shall be licensed. :/ ■. 121. Before any license for any such vehicle shall be granted, the owner, or one of the owners thereof, shall produce -such vehicle for inspection at such/imo and place as may be directed by the Town Clerk or the Inspector of Carriages, or any other officer appointed by the council to inspect public vehicles, .. . 122. Every license for any such vehicle shall bear some distinguishing letter or number, or .both, which shall -be the licensed number of-snch vehicle. i 123-- The council may from time to time, by notice published in some, newspaper-circulating in the borough, require all public vehicles,._ or any particular class thereof, to be produced at a time and place therein specified for inspection by the said Inspector. ‘ T24.- If upon such; inspection ‘ any vehicle, shall, in theopinion; of • the said ; Inspect or, be unsafe or insufficient for the purpose for which it. was licensed, he shall report the same to the council, and the council may give notice to the person or persons described as .the owner or owners of such vehicle in the license therefor, or one of themy requiring him or them forthwith to repair ors alter such vehicle,;: or the: harness used therewith, with respect- to the particulars specified in such notice, and such vehicle shall be deemed to b6 : an unlicensed vehicle from the time of service of such notice until the said Inspector shall have certified that the same has been complied l with. w ,e. 125- The number of passengers! to; he carried in any public vehicle licensed, for that purpose shall be the number stated in the license thereof, and shall not exceed one passenger for every sixteen in'ches in length of passenger seats. 126. Before the owner of-any -licensed vehicle shall permit fhe same to stand, or ply for hire, he shall cause to ,1)0 painted upon such conspicuous part of the outside thereof as shall be approved bythe said Inspector, and shall at all times keep plainly visible and mulefaced, the licensed number of such vehicle, and the name or names of the owner or owners thereof; -and in case of a passenger vehicle , the words “ Licensed to carry /’-.stating the number of passengers which such vehicle,is licensed;to carry, i~r 127. The words and figures hereby required-,tc be painted on the outside of any" vehicle, shall be painted in plain white or gold letters and figures upon a black or dark ground, and each shall Jbe.twc inches - long and broad in proportion,:and each letter not less than one inch long and broad in proportion. 128. The owner of every vehicle licensed to harry passengers shall also at all times whilst -such vehicle is* in .actual use keep exposed 1 on - some conspicuous part of the inside thereof as shall be approved*of by the said Inspector a copy of the scale o‘f fares for Ihe use thereof for the time being .-in force, j. i • I i 129. No owner or driver of any vehicle,, whether public or private, shall drive such vehicle or permit-the same to be or to stand in or upon any street or public placewithin the borough, between sunset and sunrise, unless such vehicle -shall havey .whilst, being driven or standing as aforesaid, two proper lamps, .one on either side thereof, alight, and plainly visible to any approaching such vehicle. ; 130. No person shall act as driver or conductor of any vehicle plying for hire for the carriage of passengers or goods wjtbin the borough - of -Patea without having a license to act from the. Council of the said borough, such license to be carried by such dHver and produced to any = passenger or constable’on-'demand; : ■' . - 131. Every application; < for any such license- shall have.annexed thereto, a certificate signed by- not-less than, three householders of The ability of : the (1 person making such application to act as driver or conductor as thomase may be. ! ' ■ ’ 1 132. Drivers’ and l conductors’ licenses shall be numbered in the order of The issue thereof. > ; , ■ - 133. Licensed drivers may practice their calling at all hours, both day and night. ~ 134. The. rates or fares to be paid by persons travelling in licensed vehicles shall be as follow : (a) For a mile or any loss distance, for each adult ■ :Is. ■ ■ > ; . ( hj) For every half-mile, or a fractional part of a half-thile beyond the the first mile, for- each adult passenger, 6d. (c) Donblo fareSimay:be- charged- between.;^ 1 p;m. and 7 :a,m. T ; t ■: ■
135. Fares by time shall be as follow . (a) For any time not exceeding die hour—fur a passenger vehicle drawn by two horses, 5s ; ior a passenger vehicledrawn by one horse, 4s. (&) For every; subsequent- 15 minutes or less—for ..a two-horse.'vehicle, Is; for a onc-horsc-vehicle, 9d. (c) For hiring u carriage and not further employing the same the charge shall bo Is. ~ {d) For detaining-a licensed carriage' more than . ten minutes tiro'charge shall be for every quarter of an hour,' Is. 136. Fares by distance shall be reckoned from the place from which the hirer starts. ' 137. When a licensed.carriage is dismissed outside the borough boundary, halt-fare back to the borough boundary may be charged. / f o 138. No extra charge shall bo inadp: for luggage not exceeding 141b. in weight for each adult passenger,139. Two children between the .ages of two and twelve shall be reckoned as one adult. Children under that age free; ■' 140. DrivcrsJiired by lime shall drive at the rate of .at least six miles an- hour, unless unavoidably derlayed or required by the hirer to drive slower. 141. Drivers shall not be compcdled to go outside the borough boundary except on metal roads, "nor then more than eight miles, unless by special"agreement. 1 142. No driver or passenger-shall smoke in any; licensed vehicle whilst, being used for. carrying any passenger or .passengers, , without the express consent of all passengers for (ho time being.in such vehicle. 143. No driver or ; conductor shall misconduct himself in any of the followingmatters, that is to say:— > . . (lc) Not having the : name of the owner or other matters required by any bye-law," shown on any vehicle in his charge. , 144. No person shall carry any loaded firearms or • any other - dangerous weapons, ■ or discharge any firearm, within: the borough -without lawful excuse : Provided that this part- of these, bye-laws shall not apply to any person in; Her Majesty’s military or naval services,: or; any constable, peace officer, militiamap, or volunteer on duty. :...... Part X.—Pedlars and Hawkers. 146. From-and after the commencement and’ coming into’ operation of ; this bye-law, it shall not be lawful for any person to carry-on (he business of a Pedlar or Hawker (except as herein provided;, for); in< any place whatsoever within -the,,, borough without: having' ■ previously obtained a license as hereinafter directed;- i - 147-. Every -person • carrying on such business as aforesaid shall :be deemed and taken to-be unlicensed . unless, he shall prove to the.contraiy by the production: .of his license.or otherwise. ..... y • ; 148. There shall- be two descriptions of Pedlars’ • and-Hawkers’licenses,: the one authorising the holder thereof to carry, on his > own person ins "wares and merchandise for the purpose-: of isale-;- and* the- otherauthorising the holder thereof to carry his wvaces.and merchandise for the purpose of sale by i pack horse brother animal,-or by cart or other vehicle. • 149. : Every person desirous of'obtaining a Pedlar’s and 'Hawker’slicense- shall deliver to the Town Clerk a'uotice- in writing applying for the same, and suchapplication shall not'be’.considered by the council untilnotice shall.have.been delivered to and lodged.with;.the; Town Clerk three clear days at least the day fixed for an ordinary meeting of the council. -150. With the notice of application there shall'’Be delivered to. the Town Clerk a certificate of-the good character of the. applicant, .signed;'by at least three householders resident'in the borough. ... ■ 151. The Borough Council may in-their discretion grant or refuse such application. ' T52.
