Some fun was occasioned (says the Southern Mercury ) in the liesident trate’s Court, on Tuesday afternoon, during the bearing of a case of cattle trespass, brought on by A Montgomery against Win. Dison, both parties residing at Portobello. The plaintiff and Ins witness were each at a loss as to dates, also a» to> the amount of damage done, and to make matters worse, they did not know who the owner of the beast was. The principal witness for the plaintiff deposed as follows : —My friend Billy Dixon has a garden with some cabbages in it. One night a bullock came in and ate the cabbages.— His Worship ; Did you see it ?—Witness (after about a minute’s deliberation) ; I don’t think 1 did. Stop! I’m wrong. Between you and me, Mr Bathgate, I did— His Worship; What date was this?— Witness : On the 29th June.—His Worship : That date has not arrived yet.—Well, it was on my birthday, and 1 remember it perfectly.— His Worship : Perhaps it was .May.—Witness : Yes ; on Monday, the 29th of May.—His Worship ; The 29th of May was on a Tuesday.—Witness ; But you must remember it was leap year. —His Worship at this stage gave the witness up as a bad job, and told him he could stand down. The plaintiff’s evidence was somewhat similar in character, and he was nonsuited. On leaving the Court, he said he would find out the owner of the beast by killing it the next time it took a fancy to Lis cabbages.
