At the S.M. Court yesterday. Hans J.Jensen claimed £I2S 17: dd from "Archie Smith damages alleged to bo due to a collision on Tastnan Koad. Plaintiff stated: 1 am a taxi-proprie-tor residing at Otaki beach. 1 own a Chandler car, and am frequently up and down the road. On April 3rd 1 had a number of passengers on the car and was travelling at 10 io 20 m lon ■•'» hour. 1 saw Mr. Smith approaching 1,3 >' arfU Off, on a clear road. ] pulled '•if the road a- far as I could. T. have frequently met Smith on the road; there i- amp].; room to pass, and had Smith pulled his car of! there would have been no collision. I claim £2 per day lor the U:u>: my car w:. - laid up. To Mr. Dunkh-y; There are Borough Council pipe- on the side of the road, and one pipe where the collision occurred was on the side of the road. I cannot say if Mr. Smith slowed down, [and cannot say how many cars passed | over the road thai day. [1 first noticed Smith's car about 500 ! yards off. We were travelling about Id miles an hour, but on nearing Smith '•■■'.- slowed down to about 12 miles. Smith's car seemed to have more room than we hud. We had pulled over us far as possible to the *idft of the road; Jensen appeared to have perfect sontroi of the car.
To Mr. Dunkley: There is a dip on the sside of the road. After .Smith's car passed as it turned straight into the lupins. Oswald Keith Jepps, of Wellington stated: I was on the mud-guard when the collision occurred. Jem-en'a ear could not have gone further over to the side of the road unless going into the ditch. At this stage the light became so bad that the. S.SL adjourned the case, intimating at the same time that he would visit the locality before proceeding with the- ease next Court day
