Evidence by his wife that lie wa home on the night of November 2 last, when the prosecution alleged tlia he was trapped in a eompromisin situation with a woman during a polic raid on an alleged disorderly flat, fail cd to win a verdict of acquittal fo Colonel Augustus Drum Porter, n di.missed Deputy Police Commissioner o New York City. Porter was charged with neglect oi duty by ordering police not to inierfert with an unnamed women In the case and not to make a report of the biei dent. His trial was the first of « scrim of indictments involving other polic* officials. After 20 hours' deliberation the ju:\ reported to the presiding judge that they were in hopeless disagreement, and they were discharged. The Prosecutor announced lie would move for a new trial immediately. Colonel Porter's accusers are two police constables, who last November were employed tapping telephone wiies to suspected houses. They stated that after entering a tint in West Xinetvseventh street they surprised Porter and an unknown woman, ami that Porter, their acting superior otlieer. enjoined them to ignore the incident.
