POSSESSION OF VICARAGE
CLAIM BY CHURCH BOARD P.A. NEW PLYMOUTH, Nov. 26.
Possession of the Fitzroy vicarage from the Rev. J. C. A. Zimmerman, former vicar of Holy Trinity Anglican Church, Fitzroy, was the unusual claim brought by the Taranaki Church of England Trust Board in the New Plymouth Court, before Mr W. H. Woodward, S.M.
After submissions for the plaintiff had been made, and evidence had been given by Andrew Blair Whyte, diocesan registrar and lay member of the Board of Nominations, that no records were kept of the board meeting which decided that a change in the vicarship was desirable, counsel for the defence moved ' for a nonsuit on the grounds that it had not been proved that the defendant had received a, communication from the bishop of Waikato, Bishop Cherrington, revoking his apppointment as vicar, and that the appointment had never been properly terminated. On this point the magistrate reserved his decision
