HEAVY DAMAGES

INJURIES TO YOUTH

CLAIM AGAINST MOTORIST P.A. WELLINGTON, Nov. 26. A jury in the Supreme Court, after a hearing extending over three days, awarded a youth aged 18 years, £499 10s special damages and £6OOO general damages against Herbert McDowell, a bus driver, for injuries suffered when he was run down by a motor car in Cuba street, Lower Hutt, on June 29, 1945, and suffered injuries which caused him to revert to childhood. The public trustee, the young man’s guardian while he is an inmate of the Porirua Mental Hospital, claimed £499 10s special damages and £12,000 general damages. The case was heard before Mr Justice Fair.

The plaintiff alleged negligence by the driver of the motor car while the defendant held that the accident had been caused by the youth failing to cross the street on a pedestrian crossing and failing to keep a proper lookout while running across the road.
