Thursday, October 3 (Before Mr J. R. Bartholomew, S.M.) Undefended Casc„ Judgment by default was given for the plaintiffs in the following cases:— Rose Ellen Lowe v. A. R. Gillan, claim 14s 2d for goods supplied, with costs (15s); Reillys Central Parking Station, Ltd., v. G. Newey, claim £29 Os 7d, for goods supplied and work done, with costs (£4 5s 6d) Claim for Freight Walter Black, of Nelson, proceeded against George Stanley Kirby on a claim for £lO 14s 7d, the amount alleged to be owing in accordance with an agreement between Percy James, as agent , for the plaintiff, and the defendant—Mr I. B. Stevenson appeared for the plaintiff and Mr N. Allan for the defendant.— Outlining the claim, Mr Stevenson explained that James had been asked by the plaintiff to find a buyer for a piano,, and thi resulted in an interview with Kirby, who, it

was alleged, had agreed to pay £lO towai'ds the cost of bringing the instrument from Nelson to Dunedin for inspection. Later, however, he repudiated this arrangement.—The defence was a denial that Kirby had agreed to pay any portion of the freight on the piano.—After hearing evidence, the magistrate said that it was all in favour of the plaintiff, and gave judgment accordingly for the full amount, with costs (£4 12s).
