The plaintiff in 'the proceeding case, next claimed Ll:0, .as compensation for loss sustained through an assault upon liis wife, said to have been committed by the defendant on the "29th wit. Mrs. Uarn«itt stated —On the 29th ult. I saw the defendant in Jlopesfrect. I s;;id that I wished to apeak to him, and be replied, " I'll talk to you to-morrow." I snid, "If you dou't give me my money in three days, I'll summon you." He culled me a"lowb ——," and I ceiled him a " low :swecp," and gave him a smack in the face. He turned round and struck me a^ain. I went to pick up a handful of mud; but lie caught me and threw me on my back. Mr. Strode said it was not' necessary to go any further ; seeing that Mrs. Darnett had clearly proved that she struck the first blow. .-It was unmanly to strike a woman ; but there were casts in which something must be done—such as holding the hands of a desperado. The plaintiff must be non-suited.
