Mr. Jus ice R : c!un uid gave judgment in the suit of Captain Williams, owner of the hulk Eli Whitney, against the owners of the Taupo to recover L3OOO damages for the loss of the hulk run down l.y t.ie Tanpo and sunk. He did Hot. regard the collision as an inevitable accident, as the hulk might have been seen by ordinary eyesight. His Honor held that the hulk was confessedly in fault for having v.» lig-its, but Whatever law or regulation might govern the ease, the fault did not disentitle her to claim compensation from the other party, whose carelessness conduced to the accident. He th-vefore condemned the Tanpo to one half of the damage ; each party to pay his own costs. It being further understood that the costs of reference as to the damage, if one became neci ssary, should be borne in like manner, unless the Court should hereafter order to the contrary.
