RESIDENT MAGISTRATE'S COURT.
THIS DAY. [Before T. W. Parker, Esq., P.M.] ASSAULT WITH INTENT. David Buchanan, remanded yesterday on the above charge, was again brought up. Mr. O'Mcagher, counsel for the prisoner, said that lie wished to put in the deposition of the prosecutrix, taken 011 a previous occasion. Mr. Hislop objected to this course, as prosecutrix had not denied that the statements therein were not made by her, and that she had not been cross-examined as to them. Mr. O'Mcagher having replied, His Worship sustained the objection. Mr. O'Mcagher then, intimated that he would call no further evidence, but would ask the Bench to commit the prisoner for trial at the next sitting of the District Court. His Worship stated that although there was not suliieient evidence to sustain the charge of attempting to commit a rape, there was a strong case made out on the lesser charge ; and the prisoner would, therefore, be committed to stand his trial at the next sitting of the District Court on the 22nd instant.
