SUPREME COURT—IN BANCO.
Thursday, September 25. (Before his Honor Mr. Justice Richmond.) HOLMWOOD V. THE -MERCANTILE MARINE AND EIRE INSURANCE COMPANY. This was a demurrer case, Mr, Travers appearing for the demurrer, and Mr. Buckley in support of the declaration. After hearing the argument, the Court reserved judgment. SMITH (APPELLANT) V. JOHNSTON (RESPONDENT). This was a motion by Mr. Ollivier, for respondent, for costs under section 21 of the Appeals from Justices Act, 1867. Mr. H. Travers appeared for appellant. Verbal notice of appeal was given. SCHULTZ V. CORPORATION OF WELLINGTON. This was a motion for a rule to show cause against a rule granted on the 16th, which was to show cause why a previous rule should not be set aside. Mr. Ollivier appeared for plaintiff, and Mr. Travers for defendants. The arguments wore lengthy, and a number of cases were quoted. It was ultimately decided that upon the plaintiff agreeing to strike out the third count of the declaration, the rule would be discharged without costs. The Court then adjourned till next day.
