Friday, Jolt 18. (Before his Honor the Chief Justioe and Mr. Justice Richmond.) IN RE RHODES’ WILL. Mr. Travers applied, in the matter of Rhodes’ will, for an order by consent, but as it appeared that the persons interested were not properly ascertained and before the Court, to enable the consent to be given, the matter was adjourned for the purpose of supplying this. HOUGHTON V. MOODY AND COMPTON. Mr. Travers appeared to show cause against a rule obtained by Mr. Ollivier for the defendants, and applied that a nonsuit should be entered on various grounds, chiefly that no evidence was adduced that the plaintiff had any estate or interest iu the land and premises as would entitle him to recover possession, and that there was no evidence to show a valid and effectual indorsement of the policy of assurance from Moody to Compton, which was the only breach relied on by the plaintiff at the trial. It was applied for in the alternative that judgment should be stopped because the declaration disclosed a joint demise by the plaintiff and three other persons who were not joined iu the suit. Their Honors reserved g judgment. The Court adjourned till 10 a.m. to-day to dispose of the remaining cases, namely, the arbitration case of Corporation and Watson.
