time he should ask it ; and then he played a tune on the piavo, and when the instrument was shut said it would be the last time he would play them a tune. In the morning he was found dead in his bed, with the laudanum bottle empty near him. A post-mortem examination showed that he died from laudanum poisoning. The policy of assurance contained a provision to the effect that it would be void if the assured died by his own hand. The company defended the action on two grounds —first that the assured had died by his own own band, or, iu other words, that he had committed suicide ; secondly, that at the time of the proposal for insurance he was a person of intemperate and irregular habits, whereas he had stated that he was of sober habits ; and there was a condition in the policy that if these answers were untrue the policy was void. The company alleged that the answers were untrue, aud that the assured gave the answers wilfully. For the plaintiff several witnesses were examined as to the latter point, who proved that Young, so fas as they knew him, was of temperate habits ; that he always attended to his business, and was never seen to take any intoxicating liquors during business hourt. And as to the allegation of suicide, it was contended that the facts were quite consistent with his having taken the laudanum accidentally, and not purposely. The jury found a verdict for the defendant on all the issues.

The pensions of Erench officers are smaller than in any other army in Europe. In fact, an officer cannot claim his retirement until he has served for thirty years, and then he receives only 1560 f., or about £6O a year. The maximum pension which a captain can attain to is but a few pounds more; and even a full colonel only gets 3120 f., or £125 a year. Gambetta has therefore introduced a Bill which proposes to enact that every officer who retires after completing thirty years’ service, shall receive a pension equal to two-thirds of the full pay of his rank, and that for every additional year that he serves, one-twentieth of the difference between this minimum pension and full pay shall be added to the retiring allowance. In order, however, that the State may not be burdened with providing this increase of pension, 5 per cent, of the officer’s pay is to be stopped every year, instead of the 2 per cent, which is now kept back.
