VICE-ADMIRALTY COURT.

(Before the Worshipful C. W. Richmond, Deputy Judge.) IN RE THE &.S. taUPO (Carey, master). The following report of the Registrar on the case was brought up : To the Worshipful C. W. Richmond, Judge ami Commissary of the Vice-Admiralty Court ef New Zealand. Whereas by your degree of the 18th September, 1877, you pronounced that the owner of the steamship Taupo was liable for one moiety of the damages sustained by William Corbett Williams the owner of the vessel Eli Whitney, of Wellington, and condemned Michael Carey and the bail on his behalf to answer the action in one half of such damage ; and moreover referred the proofs with such accounts and vouchers as should be exhibited to your Registrar and merchants to ascertain and report the amount of such damage: And whereas on the 6th October the proctor for the Eli Whitney brought in an account of damage, loss, and expenses sustained by his party, and adduced evidence in support thereof. —Now I do most humbly report that having been assisted by Messrs. George Thomas and Daniel Mclntyre, of Wellington, merchants, and havinglaid before them all necessary papers and the evidence adduced by the parties, and the proceedings in the said cause, we took the same, together with what was urged by the parties, their agents, and proctors on both sides into consideration, and are of opinion that the said William Robert Williams, the owner of the said vessel Eli Whitnej', is entitled under the aforesaid decree to the

several sums stated in the schedule hereunto annexed. All which is humbly submitted by _ Alex. S. Allan, Registrar. The schedule referred to in the above report is as follows Total damage—Coal on board the Eli Whitney, assessed at £l2lO ; sum allowed, £620. Hull, £llsO ; sum allowed, £574. Hoisting engines, £250 ; sum allowed, £125. Anchor, chains, gear, and stores, £2OO ; sum allowed, £IOO. The Court confirmed the report. Appeal asserted by consent. The decree to be carried into execution by the amount awarded (£1420) being paid to the petitioner (Williams) on his entering into the usual security to refund in the event of the appeal succeeding.
