The Dttiij/-Times-of- November 22 says that the Bessemer steaipship, < purchased from the original proprietors by Mr. W. Sugden, iron merchant, of Leeds, has been rearranged and refitted so as to be adapted for sea-going passenger traffic, A trial trip will shortly be made in the Humber, and a speed of seventeen knots.an hour is looked.for. , An important "definition of the distinction between a crossing and an overtaking ship was recently’ given by Sir W. B; Brett, Judge of the Court of Appeal in the Franconia case. The facta iof ;the case are, says the OtagorDadly Times, thus statedßoth of the ships werC, -proceeding down the. English Channel one behind tbo other.’ - The forward ship; the Strathclyde, was steering! south-west" by south ; the hindership, the Franconia. was steering south-west by west; therefore the-lines on which they were steering crossed each -other, • the Franconia was going faster than the other; and gradually overtook her. When the—Franconia - had overlapped the other, and was about three ship-lengths distant from her, she suddenly ported her helm, and almost Instantly came into violent collision with' the Strathclyde and sank her. The Court of Appeal decided (confirming the decision of Sir Robert Phillimore), that the Franconia was alone to blame. In the course of his judgment, Sir William B. Brett said that terms employed in the regulations were not to be regarded as mathematical terras.'but a* terms of navigation. He then stated the distinction between a crossing 'and an overtaking*ship in the following manner:—lf the position and courses of the two ships were such that the hinder ship could not possibly see either of the side lights of the other, the ships were not crossing ships, but the hinder one was an overtaking ship. In such a case, though the mathematical lines representing the two courses would intersect, yet, unless the hinder ship was going faster than the other, a collision co<dd not occur.
