A special sitting of the Court of Appeal was held this morning before the Chief Justice and Mr. Justice Johnston. In the case Regina v. Woodgate, Dr. Foster and Mr. Rogers appeared Toy prisoner, who was convicted at Blenheim fop. the murder of his illegitimate child in a lonely part of Queen-: Charlotte Sound. Th e points raised by his counsel were —First, that the child had not been horn ; second, that there was not sufficient corroborative'testimony to enable the case to go to a jury on prisoner's own admission of guilt.'. .The ' case was argued At considerable length by Dr. • Foster, who quoted a large number of authorities on’the'subject. Ultimately' the convic- ' tion of the jury was affirmed. The only other case before " the - Court was "that of * T.~ *H. -Knibbs, convicted last session here of stealing a letter from'a private box at the: Post Office. The point raised by counsel was that a letter on being placed in the letter-box ceased to be vested in the Postmaster, who - was the prosecutor. The Court held this not to be tenable,, and affirmed the conviction of the-jury; Tapanui (Otago); Friday. For the Tapanui races the weather was glorious; and 500 .people' were present.
