Saturday, August 28. (Before J. C. Crawford, Esq., R.M.) FRAUDULENT PRETENCES. Thomas Roche was brought up on remand, charged on the information of R. G. Read, with obtaining the sum of £SO from Robert Hatherton Edwin,- by means of fraudulent pretences. Mr. Travers conducted the prosecution. Leonard Greenwell Read deposed that the prisoner came on the 12th inst. to the office of Messrs. Travers and Ollivier, accompanied by a person named Hslps, from Nelson, and stated that he had served in the Taranaki Military Settlers, and that he was entitled to a grant of land in the Wairoa district. He said that he had lost the certificate, and that if. witness would prepare a declaration as to its loss, he could then get a grant from the land office. Witness afterwards. found tie declaration to be unnecessary, and he then prepared an order to receive the grant, which was signed by Mr. Dransfield. Witness read the draft declaration to the prisoner, declaring that he had never disposed of the land in any way. Prisoner assented to what was read. He afterwards applied for a loan of money, saying that the land was worth £2OO, and that he did not wish to sell it, it being near the township, and likely to become very valuable. The defendant gave witness an order to receive the Crown grant. Witness received the grant from the laud office, and prepared the mortgage, which the defendant executed, in the presence of witness, and a cheque for the amount was handed over to him, less the expenses.. William Thomas Locke Travers corroborated theevidence given by thelast witness, and further deposed that the prisoner distinctly stated that he was the owner of the land, and in consequence of this statement, witness asked Cap-. tain Edwin to advance the money, which he consented to do, and gave a cheque for £SO. The mortgage was prepared for Captain Edwin, and in its execution, the prisoner received a cheque for £42 .10s., the balance being reduced in respect of fees. Witness afterwards discovered that a conveyance had been made by the prisoner, in 1868, of the land in question, to a person named Archibald Brown., William Fox Cheesman, Deputy Registrar of Deeds, proved the registration of the mortgage deed. Leonard Greenwell Read, recalled, deposed that Ke signed the mortgage deed as an attesting witness, and that the prisoner signed it in his presence. Mr. Travers applied for a remand to enable him to obtain from Wanganui witnesses to prove the conveyance of 1868. The Bench accordingly remanded the prisoner for a week. VAGRANCT. William Shelton gave himself up to the police the previous night, stating that he had no means of subsistence. The Bench committd him to gaol for one month, with hard labor. CIVIL CASE. E. Willis v. J. Kirk.—The plaintiff, claimed £1 2s. for wages, which included a week's wages in lieu of warning. The plaintiff deposed that she was servant to Mrs. Kirk, and that one evening she asked her mistress for leave of absence for the evening, which was granted. On her return home at a quarter to ten' Mr. Kirk said that it was inconsiderate in her to ask for leave of absence when her mistress was so ill. On this an altercation ensued, which resulted in the plaintiff leaving. The defendant did not dispute these statements, but added that the actual amount due was Is., as the plaintiff owed money for goods supplied to her, and that she had left of her own accord. The Bench gave judgment for Is., the parties • to pay their own costs.
