BANKRUPTCY COURT.
Tuesday, August 3. (Before his Honor the. Chief Justice.) The Court sat at 11 a.m. IN HE HENRY WEST. Mr. Cheesman for bankrupt. This was an application for an order of discharge. It was stated that all requisite notice had been given to creditors of intention to make the application, but none had signified any opposition. Bankrupt made the usual declaration as to the correctness of all statements made by him, and His Honor made the order as prayed. IN HE WILLIAM PEARCE. Mr. Cheesman for bankrupt. This was a similar application to the last, and His Honor granted bankrupt his discharge. IN KB MULLINS, EXPARTB GALLAGHER. Mr. Shaw applied that Gallagher, who had been obliged to bring an action against the trustees in the estate of Mullins, storekeeper, of the Hutt, to recover salary, might be allowed costs. Mr. Shaw said he relied on the 207th section. His Honor said he thought the trustees had been ill-advised in coming to court, but as Gallagher had asked for more than he was entitled to, it was not fair to give him costs. Mr. Shaw said it would be very hard not to allow costs, because substantially the suit would involve Gallagher in a great loss. His Honor declined to allow costs.
