DEFAMATION CASE
DAMAGES AWARDED (By Telegraph—Preaa AwociationJ WELLINGTON, This Day. Reserved decision was given to-day by the Magistrate, Mr McNeil, in the case in winch William Tressider, watersider, claimed £IOO damages from John Barrett, one time manager of the Courtenay Club, alleging that defendant had accused him of rooming a young man named Fitzmaurice by using crooked dice in a game of hazards at the club. The Magistrate found that a case of defamation had bqen established. Willi regard to the defence that an action could not lie as the alleged slander arose out of participation in an illegal act, namely, in playing a game of hazards, it was held that "uecided cases showed that even if a man had taken part in an illegal transaction he was not to be deprived of all protection in other matters connected with the transaction. A sum of £ls damages was awarded.
