Eltham Co-operative Dairy Fuctory Co.. a claim for £'lol lbs r .i\, balance due for milk supplied. The company altered the articles so that if a member did not supply milk for the whole season he should get no bonus. Front 4th November. 1924. to 28th Februarv, 1925, plaintiff supplied only half his'milk, and claimed £lOl odd, cm the ground that the change was ultra vires. The Judge held that such change could he made, bin: must be brought to the notice of suppliers, and plaintiffs statement that he was not present at the meeting when it was adopted and was ignorant <vt the decision must be accepted. Judgment was given for the plaintiff.
