RESIDENT MAGISTRATE'S COURT, February 8.

(Before W. H. Retell, Esq., 11 M,) W Howe v. J. Burrow. Action to recover the sum of £89 128, out of which £60 was claimed for damage done to a stack of hay owing to the defendant's cattle breaking in and destroying it; the remaining items were for grazing fees, &c. Mr Jones, of Reefton, appeared for the plaintiff, and Mr Bunny, of Nelson, for the d-fendant. This case occupied the Court for a considerable time, and and at the conclusion of the evidence, counsel on both sides addressed the Court, after Avhich His Worship nonsuited the plaintiff with costs. //. W. Afason v. C. Holman. Mr. Ha9olden, of Westport, for plaintiff, and Mr Buuny for defendant. Action to recover £25 damages for goods detained. The evidence in this case was very conflicting, the only witnesses being plaintiff and defendant, who had formerly been in partnership. His Worship, in giving judgment, said he was called upon to decide which of the parties was the witness of truth, and he stated distinctly that he unhesitatingly be lieved the evidence given by the defeudaut. He therefore nonsuited the plaintiff with costs. Woods v. May and Cullen. Action to recover £45, wages due. The plaintiff appeared in person, and Mr Bunny for the defendants. The plaintiff, by his own evidence showed (hat he had taken a subcontract from defendants and had not completed it, and that no arrangement bad been made for wages. At the conclusion of his evidence, His Worship directed a nonsuit to be entered with costs. Fox v. Lloyd. In this case the plaintiff sued the defendant, who is agent for the Public Trustee, for nioneyß held in hand on his behalf. The plaintiff conducted his own case, and Mr Haselden appeared for defendant. The Resident Magistrate stated that the plaintiff had sued the wrong person, and must be nonsuited. There were a number of other civil actions settled out of Court.
