[Before J. Shephard aud H. E. Curtis, Esqs., J.J.P.] Vagrancy. John Lane was charged with being in the enclosed yard of Mr John Scott bet wen five and six a.m. on the 21st instant without lawful excuse. Discharged with a caution. The Evils of Drink Again. Samuel Bolton was charged with allowing a horse tp stray in Franklyn street. Defendant admitted that the horse was in the street, hut said that it had only gone out to get a drink, and had not been out more than five minutes. Fined 5s and costs. " Tommy " Trotted out once more. ' Wiesenhavern v. Kerr. — Action to recover £9, being £5 for five years' graziug for the horse "Tommy "; £1 for operation on the said horse; aud £3 expenses for breaking him in. Mr Bunny appeared for the plaintiff and Mr Pitt for the defendant. This horse was recently the subject of a lengthy action between the same parties, when Kerr was adjudged to be the owuer, though Wiesenhavern had been in possession of it for some years The present action was therefore brought to recover grazing fees and other expenses. After hearing the evidence the Bench decided not to allow the depnsturage fees, but gave judgment for the balauce of £i with costs.
