Mr Pitt applied, on behalf of the Trustee, for the advice and opinion of the Court respecting certain buildings and their conteuts upon land belonging to the Corporation and which, the Trustee was advised, did not pass to Mr Walters under his mortgage or bill of sale.
Mr Acton Adams, for Mr Wntters, argued that, although not actually included i tl the mortgage, the land was an easement to the freehold, and, therefore, passed the conveyance because it was au appurtenance thereto. Me was not preparhd to go into the case at engtb, as he had only received the papers last night, but he submitted that the matter was not one for the opinion of the Court under the 111 th section of the Act, as it did not concern the management of the estate, out was simply a question as to whom the property belonged, and that could only be settled by regular proceedings before a jury. However, he hoped the matter would not be decided now, but would be allowed to stand over for a few days. i
