. f Before his Honor Judge Bboad.] The Alleged Perjcry Case On the Court resuming this morning, the first witness examined for the defence was C. K. Turner, who said: On the Hth of L Afay I went into town with a two horse load or firewood. I saw pri3oner in Bridge-street between one and two o'clock. I Sa ,v Kitching the cab driver. He paid me £l that day on account of a horse I had sold him I made an entry of it in my note book when I eot home a little before dark, r didn't go out shooting that day. I saw Mis 3 M'Gee and the. servant when I was in town. I saw Harvey's cattle in the pound as I went to town. They were not there when I returned I went out shooting on the following day with William Harvey on my own and Harvey's laps. J Cross-examined: I made the entries in my note book on the evening, of the 14th of May I was m town on the following Wednesday on which day a load of wood came in from myipiace. I cv. led at Bay View on toy way out; and borrowed a red setter from Peter Martin. I recollect the 14th of May so well because it .is. entered in my book I can't say|h w: many loads went iv that month I tidy were all entered on the day of delivery' I had a man named Morgan with me for about a month. I don't know why he left rae. I have not seen him since. He was in the bush on the Uth of May. I did not see i W. Harvey that day. I got home at dusk and fed the cattle and horses. I did not ' speak to Isaac Harvey when I saw him in town. The entries id the book are in my handwriting. (Witness was here requested to \fnte the same words, which resembled those in the book.) I have not been on Mead s land since the shooting commenced William Haddow produced his book's whichc proved the correctness of certain entries in Turner's note book. Arthur Kitcbing : On the 16th of May Turner brought in some butter and delivered it to Mir Hounsell. James Bisher : I was out shooting on the 14th of May on Happy Valley, It was raiumg. I was out again on the 16th of May, which was fine. I called at Bay View on my way back. Mrs Powell was theie at tne time. Archibald Kitching : I hired a horse from Turner on the 27th; of Match. They didn't know on what day Christmas Day fell or when were their own birthdays. These two were the only witnesses who actuallyswore to seeing the prisoner on Meads' land on the 14th of May, and Mr Fell argued tfiafc it was impossible to attach any importance to their evidence. Mr Adams having addressed the jury for the prosecution, Hi» Honor commenced to sum up at half-past three, and had not concluded when we went to press.
