RESIDENT MAGISTRATE'S COURT.
[Before L. Broad, Esq., 11.M.] Warren v. Charles Harley, John Sharp, J. A. Harley, and T. H. Harley. Action to recover £60. Mr Pitt appeared for the plaintiff ard Mr H. Adams for the defendants. The basis of the action was .is follows -~ In February, 1871, Thomas Field let to the defendants for 14 years the premises known as the " lied Horse Hotel " with all the outbuildings, which were to be kept in substantial repair. Afterwards Field transferred all his reversion in the said premises to the plaintiff who, it was alleged, had failed to keep certain stables in repair, wherby the p'aintiff's reversion was injured, and the said stables were rendered useless. The defence was that the defendants were not liable for such dilapidations as result from the natural operation of time and the elements, and it was stated that the stables were in such a condition as to be past all repair. On the other hand it was alleged that if the stables were in such a state it was entirely owing to the defendants' neglect. The case was bristling with points of law, all of which were argued at length, and eventually his Worship reserved judgment
