RESIDENT MAGISTRATE'S COURT.
[Before L Bboad, E«q , R.M.] Pool v. Smith.— -la this case the plaintiff sued the defendant on a cheque drawn by him for £30. It appeared that a billiard match was arranged aome weeks ago between the plaintiff and one Hill for £50 a side. Of this £30 waa to be found on bebalf of Hilt by Dogberty, who for that purpose gave to Infield, the stekeholder, a cheque for £30 which he had received from Smith, the defendant, in payment for cattle. The match was won by Pool, to whom the stakes were handed over. Thereupon, Dogherty, who, it appears, had some suspicion of foul play, telegraphed to Smith, a resident at *Siq Lyell, to stop payment of the chtque, which he did. Hence the action. Mi Pitt appeared for the plaintiff and Mr Fell for the defendant. Arguments at length were heard regarding the legality or otherwise of the transaction, Mr Fell contending that the cheque had been obtained for an illegal consideration. Judgment was reserved until Monday.
