RESIDENT MAGISTRATE'S COURT.

This Day. William Orsman was charged with having " cruelly beaten. ilUtreated, abused, and tortured " a certain horse. The evidence for the prosecution showed that the horse io question was severely beaten about the head by the defendant because it would not back a dray up the Government wharf. Mr Pitt, who appeared for the defendant, said the information was bad in charging four separate offences, as he contenJed that it did, and further tbat the defendant bad been severely bitten on the hand by the horse, and that it was under tbe provocation of the wound that the beating bad been inflicted. His Worship said that the evidence fully justified the charge as laid, and fined the defendant £1, and costs 16s 6d. Jones v, Moutray. — Claim for £9 4s for carting. Mr Pitt appeared for the plaintiff, and Mr Fell for the defendant. Defendant paid £4 4s into Court, and pleaded a set off of £5, the price of certain hay racks made by him to plaintiff's order. After a long hearing, and the examination of witnesses on both sides, his Worship said that where so great a conflict of evidence existed he could only decide in favor of the side towards which the balance incliced. The evidence of Mr Moutray being supported on certaia material points, he gave judgment for the defendant for the amount of the set off claimed by him, and£l 13s costs, plaintiff receiving the money paid into Court.
