I N B A H C O. . [Before hia Honor Mr. Jxjstiob"Riohj_ohd.3 This Day. Eyes v. Henderson. Ia delivering judgment this morning on tbe motion made laat Friday by Mr Acton Adams for a rale niai for a new trial, his Honor said that there appeared to be sufficient doubts on some points to induce him to grant the rule, at the same time suggesting that tbe matter should be argued before all tbe Judges in the Court of Appeal. Kule granted on all the grounds, there being some nicety about some of them, and none of them being 'without foundation. Returnable at Nelson on Friday October 3, unless the parties can arrange to have it returned jbeforejihe Court of Appeal. Mr Acton Adams said he should be only too glad to hand the case over to Mr Travers to argue at the Court of Appeal, and Mr Pitt promised to see tf Me Conolly wool- content*
