MAGISTRATES' COURT.

Before J. Sharp, Esq., R. M., and D. M. Luckib. Esq., J. P. Busk v. Kynnersley. This was an action to recover the sum of £2 Bs., for damages sustained by plaintiff owing to a breach of contract on the part ot the defendant, with reference to a promised lease of land at Wangapeka. The grounds of action were similar to those in the case of Dreyer v. the Superintendent, which was folly reported in our columns a fortnight ago. Mr. Fell appeared for the plaintiff. Mr Kynnersley objected to Mr Sharp hearing the case on the grounds that he himself was not personally liable but that the action was brought against him in his capacity of member of the Provincial Government, and that as Mr Sharp was, at the time when the lease in dispute was promised to the defendant, also a member of the Executive, he did not think that he should sit in judgment in the case.
