NELSON BOARD OF WORKS.
Friday, November 15. Present : All the members but Mr. Haddow. The Surveyor was instructed to advertise that the assessment list would be open for the inspection of the ratepayers at the office of the Board on and after Wednesday next. The Chairman read a letter received from Messrs Adams and Pitt, enclosing a notification from Mr. Fell of the discontinuance of the action commei ced by Mr. Edwards against the Secretary, and stating that the late plaintifl was liable to pay the costs incurred by the Board in the defence The following is a copy of Mr. Fell's letter : — Edwards versus Younger. Dear Sirs — I have yesterday and to-day taken notes of evidence of such a character in this case that I am of opinion that my client's case would fall to the ground from contributory negligence on his part. Under these circumstances I do not feel justified in putting my client or the Board of Works to any further expense, and I take the earliest opportunity of discontinuing the action. I am &c, €. Y. Fell. Some conversation ensued, in which the members stated that they had no intention of basing their defence on negligence on the part of the plaintiff but simply on their non-liability. The subject then dropped. A letter was received fiom Mr. Acton A^ams tendering his thanks to the Rourd for constructing the road along Shakspeare Walk from the Bridgestreet bridge to the entrance to his property, and offering, in addition to his half share of the expense, to pay for the wattling on the river bank. The letter further stated that the writer had taken the liberty of erecting a gate and fence across the road. After some discussion, the following resolution was adopted on the motion of Mr. Burn : — " That the Surveyor be instructed to acknowledge the receipt of Mr. Adams' letter in reference to the roid known as 'Shakspeare Walk,' and inform Mr. Adams that the Board regret that formal application had not been made direct to the Board for permission to erect the gate and fence, and while the Board see no objection to the same, Mr. Adams will consider that the Board reserve the right to order the removal of the said gate and fence at any future period when it may be considered necessary." The question of increased drainage was then discussed, aud Mr. Webb stated that a gentleman had offered to advance the whole sum required on the Board's debentures. The chairman offered to prepare a statement of the special rate that would require to be levied on each ratepayer, by the next meeting. Some business of minor importance was then transacted and the Board adjourned until Friday, 2nd December.
