RESIDENT MAGISTRATE'S COURT.

J. H. Heaton v. E. M. Moss— This was an action to recover £18 Bs. 6d., the price of six belts brought from Melbourne for the defendant, on behalf ot the Volunteer Artillery Company. Mr Kingdon appeared for the plaintiff. John Henry Heaton: I was requested by Mr Moss to bring 12 belts from Melbourne. He gave me the memorandum produced. I procured six belts in Melbourne, and delivered them to Mr Everett. The price was £2 18s. Cd. each, and he paid me for them, with 5 per cent, commission. The remaining sis were forwarded to the care of Cawthron. Defendant has refused to take delivery of them, and refuses to pay for them. The price is the same as for the first six. The price is the amount charged me, which I have paid. No s>rice was mentioned when I received the order. Defendant gave me the written order, and has since told me he would not have the belts.
Edward Everett: I believe the order produced is the defendant's handwriting. There waa no limit given to the plaintiff as to the price. I paid for six which were delivered to me.
Judgment for plaintiff for £18 Bs. 6d.,with 21s. costs, and 21s. solicitor's fee.
