Drunk in Charge of Car

; HEAVY PENALTY IMPOSED. At the Magistrate’s Court at Foxton Ott Wednesday before Mr J. 11. Salmon, S.M., Frederick It. C. Waller, funner, of Himatangi, was charged: (1) That on February 16th while in a state of intoxication he was in charge of a motor car on the Foxton-Himatangi highway; and (2) that on the same date he drove a motor vehicle while not being the holder of a driver’s license. Accused pleaded guilty. Counsel for accused, in making a plea for leniency, said that defendant was prepared to give an undertaking not to drive a cur in future and he would agree to a prohibition order. The Magistrate pointed out that the charge was defendant’s third and it was a question as to whether imprisonment should not be imposed, lie would take into consideration, however, the fact that it was seven years since the last conviction. Accused was convicted and lined £SO and ordered to pay 10s Gd medical expenses, in default two months’ imprisonment; £2O to be paid within one month and the two weeks from that date being allowed in which to pay the balance. Defendant was prohibited from obtaining a driver’s license before February 17th, 1940.
