JUDGMENT FOR DEFENDANT NAPIER, Jan. 26. Judgment was entered for the defendant, Henry Badley, in a reserved Jecision given by Mr J. Miller, S.M. ;n the Napier Magistrate’s Court this norning in the case of Mr E. A. Wood Inspector of Factories, against tho de Cendant, who, it was alleged, had paic ffiree workers less than the rates of pa; iuß to them. Facts in the case wen admitted by Mr John Mason for th< defendant, and tho case proceeded oi legal argument as to whether tin workers, who had not come under ai award prior to the passing of th> Finance Act, were entitled to the extr; rates of pay. The object of the section of the Ac ander which the claim was made, M Miller said, was tho restoration of cut In salary, and to grant the applicatioi isked would mean granting the worker pay they had never had.
